These Terms & Conditions govern the booking, purchase and use of services provided by The Abundance Factory, operating from Boston Bellville, Cape Town, South Africa, including services offered through the MomsBiz online storefront.

By purchasing, booking or using any of our services, you agree to the following Terms & Conditions.

1. Services Offered

The Abundance Factory offers wellness, coaching and energy-based services including but not limited to:

• Access Bars® sessions
• Kinesiology sessions for people and pets
• Personal wellness consultations and counselling support
• Business coaching and performance coaching
• Massage therapy, energetic massage and bodywork
• Energy clearing and space clearing services
• On-site energetic clearing of homes, offices or properties
• Workshops, classes and wellness events
• Remote or distance sessions where applicable

Services are intended to support personal wellbeing, awareness, relaxation, mindset, energetic balance and personal development.

2. No Medical Claims

The services provided by The Abundance Factory are complementary wellness services and are not intended to diagnose, treat, cure or prevent any medical or psychological condition.

Clients acknowledge that:

• No medical advice is provided.
• Sessions are not a substitute for medical, psychiatric, psychological or veterinary care.
• Clients should consult an appropriately qualified healthcare professional or veterinarian where necessary.
• Results may vary from person to person.

For animal sessions, owners remain fully responsible for obtaining appropriate veterinary care for their pets.

3. Booking & Payment

• Full payment may be required at the time of booking through the MomsBiz platform or other booking systems.
• Bookings are confirmed only once payment has been received.
• Prices are subject to change without notice.
• Promotional offers and discounts may be withdrawn at any time.

4. Cancellation & Rescheduling Policy

• Cancellations made more than 24 hours before the appointment may be rescheduled subject to availability.
• Cancellations within 24 hours of the appointment may result in the session being forfeited.
• No-shows are non-refundable.
• Late arrivals may result in a shortened session to avoid impacting other bookings.

In exceptional circumstances, management may use discretion regarding refunds or rescheduling.

5. Refund Policy

• Services already rendered are non-refundable.
• Digital products, workshops, events or online sessions may be non-refundable unless otherwise stated.
• Refunds for prepaid sessions or packages are at the discretion of management.

6. Client Responsibility

Clients agree that they:

• Participate voluntarily in all services.
• Take full responsibility for their own physical, emotional and mental wellbeing.
• Will disclose any relevant medical conditions, injuries, allergies, pregnancy or concerns before sessions commence.
• Understand that energetic and body-based work can sometimes result in emotional or physical responses.

Clients receiving massage or bodywork confirm that they are medically fit to receive such services.

7. Consent for Touch-Based Services

Certain services may involve physical touch, including massage, bodywork, kinesiology or Access Bars® sessions.

By booking these services, clients provide informed consent for appropriate professional touch within the scope of the treatment provided.

Clients may withdraw consent or request adjustments at any time during the session.

8. On-Site Services

For home, office or property visits:

• Clients must ensure safe and reasonable access to the premises.
• The Abundance Factory reserves the right to refuse service where conditions are unsafe or inappropriate.
• Additional travel fees may apply depending on location.

9. Animal Sessions

For pet and animal services:

• Owners remain responsible for the supervision and handling of their animals.
• Aggressive or unsafe animals may result in services being discontinued.
• No guarantees are made regarding behavioural or health outcomes.

10. Confidentiality

All personal information shared during sessions will be treated confidentially unless:

• Disclosure is required by law; or
• There is a risk of harm to the client or others.

Client information will not be sold or shared with third parties for marketing purposes without consent.

11. Limitation of Liability

To the fullest extent permitted by South African law:

• The Abundance Factory, its owners, practitioners, employees and affiliates shall not be held liable for any direct, indirect or consequential loss, injury, damage or outcome arising from the use of services.
• Clients participate in all services voluntarily and at their own risk.

12. Intellectual Property

All content, materials, techniques, branding, course materials and website content remain the intellectual property of The Abundance Factory unless otherwise stated.

No material may be copied, reproduced or distributed without written permission.

13. Right to Refuse Service

The Abundance Factory reserves the right to refuse or discontinue services where:

• Behaviour is abusive, inappropriate or unsafe;
• Boundaries are not respected;
• Services are deemed unsuitable for the client’s needs.

14. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any disputes arising shall be subject to the jurisdiction of South African courts.
